KaChing is a new and innovative system to enhance your shopping experience. No more scrambling for change or hiking to an ATM to get your hands on some cash to pay for parking, with KaChing you get the VIP parking experience.


KaChing’s head office is located at The Innovation Hub in Pretoria, from here we run operations across the country of South Africa.


Use of Site and Mobile Application


You may only use this site and mobile application to browse the content, make legitimate purchases and shall not use this site or the mobile application for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. This site and mobile application and the content provided in this site and mobile application may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. 'Deep-linking', 'embedding' or using analogous technology is strictly prohibited. Unauthorized use of this site or mobile application and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property laws or other laws.


Disclaimer of Warranty


The contents of this site and mobile application are provided "as is" without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement.

  3. We will use our reasonable endeavours to maintain the Website and mobile application. The Website and mobile application is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or mobile application or because of a failure, suspension or withdrawal of all or part of the Website or mobile application due to circumstances beyond our control.


Privacy Policy


We are committed to protecting your privacy. This privacy policy applies to all the web pages and application screens related to this website and mobile application.


We may need to provide, collect, use, store or process Personal Information of the other Party. You hereby authorise such collection, use, storage and processing where the need arises.


We shall only provide, collect, use, store or process Personal Information:
a) in compliance with the South Africa Protection of Personal Information Act ( POPI);
b) as is necessary for the purposes of this agreement; and
c) in accordance with the lawful and reasonable instructions of the Party providing the Personal Information.


We shall comply with the security and information protection obligations equivalent to those imposed on us in terms of POPI and other applicable data protection legislation, and failing such legislation, we shall take, implement and maintain all such technical and organisational security procedures and measures necessary or appropriate to preserve the security and confidentiality of the Personal Information in our possession and to protect such Personal Information against unauthorised or unlawful disclosure, access or processing, accidental loss, destruction or damage.


We shall follow our archiving procedures for Customer Data as set out in our Back-Up Policy available at the website address as may be notified to you from time to time, as such document may be amended by us in our sole discretion from time to time. In the event of any loss or damage to Customer Data, your sole and exclusive remedy shall be for us to use reasonable commercial endeavours to restore the lost or damaged Customer data from the latest back-up of such Customer data maintained by us in accordance with the archiving procedure described in our Back-Up Policy. We shall not be responsible for any loss, destruction, alteration or disclosure of Customer Data caused by any third party (except those third parties sub- contracted by us to perform services related to Customer Data maintenance and back- up).


We shall, in providing the Services, comply with our Privacy and Security Policy relating to the privacy and security of the Customer Data available at such website address as may be notified to the Customer from time to time, as such document may be amended from time to time by us in our sole discretion.


If we processes any personal data on the Customer’s behalf when performing our obligations under this agreement, the parties record their intention that the Customer shall be the data controller and we shall be a data processor and in any such case: The Customer shall ensure that the Customer is entitled to transfer the relevant personal data to us so that we may lawfully use, process and transfer the personal data in accordance with this agreement on the Customer's behalf;


We shall process the personal data only in accordance with the terms of this agreement and any lawful instructions reasonably given by the Customer from time to time; and


We may need to change this policy from time to time in order to address new issues and reflect changes on our site or mobile application. We will post those changes here so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. Please refer back to this policy regularly. If you have any questions or concerns about our privacy policy, please send us an E-mail.

Any information sharing between KaChing and its partners is bound by the Privacy Policy in this document and information is only shared with the owner's express permission confirmed on a case by case or partner level.


Service availability


All efforts are made to ensure that the KaChing system is always up and running. Unforseen events can always occur, and in these case our technical support staff will assist you through any issues you may face.


Delivery Policy


When you click to accept a parking session with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not accept any parking fees or sessions through this site or our mobile application unless you understand and agree our terms and conditions. Once payment is made for the applicable fees, it is deemed that you have read and understood the terms and conditions for such a payment. If you have any queries please contact us before accepting any sessions or fees for any service through this website or mobile application.


The parking service we provide is concluded before payment takes place and is thus seen as delivered in full. If for any reason, technical or otherwise, our customer care consultants will assist you concluding you session and adjust payment accordingly if required.


Refunds/Returns Policy


Should you for any reason wish to cancel your session you are required to do so before exiting the applicable parking area. You must advise us in writing or telephonically of your cancellation and any such cancellation must be agreed to by the person who accepted the session. You must ensure that you have another valid form of payment to exit the parking area in such a case as you will not be able to exit using the KaChing system.


Cancellation after the completion of a session will only be accepted in case of valid reasons provided and after a thorough investigation of video footage. When a session is completed, the service is considered delivered in full and is as such not returnable. If you have any issues in this regard please do contact our customer care centre as soon as possible and we will try our utmost to assist you.

Payment Options and Pricing


All transactions will be processed in South African Rands (ZAR) and all payments are managed solely by KaChing (Pty) Ltd.


KaChing receives all pricing from applicable third parties, related to the hourly rates of different parking areas. These rates are subject to change without prior notice.


Credit Card


We accept MasterCard and Visa credit cards. If you do not have a credit card please utilise one of the other payment options, or simply log off and return to the site at a later time to complete your order. All of your order details will be saved online under in the Your Account section available for use whenever you’re ready! Sorry for the inconvenience.

We reserve the right to:

  1. Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site's registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.
  2. Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.
  3. The Merchant does not have access to credit details.
  4. Virtual Card Services continually reviews and enhances its security in line with technological changes.


Monitoring


We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).


Law


The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.


Updating of these Terms and Conditions


We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.


Consent


I understand that all the designs and trademarks are registered to KaChing (Pty) Ltd and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by KaChing (Pty) Ltd for any civil action or any legal action deemed necessary against me.
